Welcome to pandorabeauty.com.  The following Terms of Service Agreement (referred to as the “Agreement”) is between the parties (you and pandorabeauty.com) upon and governs your use of services provided by pandorabeauty.com.  If you (the User) do not agree to the terms and conditions of the agreements within this document please do not access pandorabeauty.com.

 

The pandorabeauty.com website (hereinafter referred to as “PB”, “PANDORA BEAUTY” , “We”, “Our Website ” or “Our Service”) is an e-commerce website accessible via the Internet at www.pandorabeauty.com.  Please read this Agreement carefully before making use of our products and/or services.  Registering with pandorabeauty.com and creating an account binds you to the Terms and Conditions detailed in this agreement.

By using the PANDORA BEAUTY website, you declare that you have full legal capacity and are aged 18 or over.

 

Modifications to this Agreement

 

You agree that we may change the terms and conditions in this Agreement at any time.  You agree that we may change our Service or remove our Service at any time at our sole discretion, for any reason whatsoever, and with or without notice to you.  You agree that if you continue to use PANDORA BEAUTY after we have posted a change to this Agreement, then you are bound by the most recent version of this Agreement. In other words, your continued use of Our Service means that you agree to be bound by the most current version of this Agreement.

 

PANDORA BEAUTY Ownership

 

You agree that PANDORA BEAUTY, including, but not limited to the Website and the Software, is owned by pandorabeauty.com.  You therefore acknowledge that PANDORA BEAUTY owns, or we license from other companies, any copyrights, trademarks, technology, patents in and to our Service, and that you will not make any claims to ownership in this Service (or any part of the Service).  Copying any material, text, images, and or writing from pandorabeauty.com without the consent of PANDORA BEAUTY is copyright infringement and therefore subject to penalty under the full extent of the law.  (See Pandora, Copyright, below)

 

Creating Profiles and Registering with PANDORA BEAUTY

 

You do not need to register with PANDORA BEAUTY or create a profile to use Our Service. However, to take advantage of some of Our Service features you may need to register with pandorabeauty.com and create a log in account.  For example, in order to personalize your background theme you must be registered and logged in to your account.  In order to receive emails of our Super Sales, alerts on discontinued items, or just being able to contact Pierre, the Product Guru, you need to be a registered member. 

 

Registering with pandorabeauty.com is fast and simple—and there’s NO fee to become a PANDORA BEAUTY member.  If you choose to register with Our Service, you will be required to provide certain information, which includes your first and last name, your email address, and a password.  You are solely responsible for maintaining the confidentiality of your password.  Please keep records of your account information and password in a safe place.  In the event that you forget or misplace your password, you may request that information from us by contacting our customer service department via email at support@pandorabeauty.com or phone at 1-855-332-3288.  You will be asked several questions to verify your identity and then we will email your password to the email address that you have registered with Our Service. 

 

PB is committed to protecting your privacy online.  We do not, and will not sell, transfer or barter your personal information to any individual or company.  We use consumer information to process orders, provide you with your order status, or promotional information.  PB may also terminate or cancel your account or profile, without any notice to you, for any reason, at its sole discretion.  As mentioned in our “About Us” section, we take fraud very seriously.  If your account or any activity stemming from your account has been deemed fraudulent, your account will be terminated, and you will be blocked from purchasing from PB in the future.  You are solely responsible for all activities that occur under your account.  The account name and password assigned and/or accepted by PB from You, for access to Our Service shall be for your personal use ONLY.  You therefore agree to immediately notify PB of any unauthorized use of your account or password.  PB reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

 

Risk of Loss

 

When an order is placed, it is shipped to the address designated by the purchaser, as long as that shipping address meets the shipping requirements and restrictions contained on this Website.  All purchases made from the PANDORA BEAUTY Web Site are made pursuant to a shipment contract.  As a result, risk of loss and title for items purchased from PANDORA BEAUTY pass to YOU upon delivery of the items shipped via USPS.  Further, all products that leave our premises are in perfect, saleable condition, unless stated otherwise.  PANDORA BEAUTY is NOT responsible in any way for products that are damaged or lost during transit via the USPS.

 

Disclaimer of Warranty and Limits on Our Liability

 

PANDORA BEAUTY, ANY INFORMATION AND ANYTHING ELSE RELATING TO OUR SERVICE, ARE PROVIDED BY PB “AS IS” AND AS SUCH ARE UTILIZED BY YOU AT YOUR SOLE RISK.  PANDORA BEAUTY shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, to you or your company’s personal information or material and information transmitted over our system.  In particular, neither PANDORA BEAUTYnor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

 

ALL EXPRESS, IMPLIED, STATUTORY AND OTHER WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.  PB IS ALSO NOT RESPONSIBLE FOR, AND DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY WARRANTIES FOR THEIR SECURITY, RELIABILITY, ACCURACY, TIMELINESS, AND/OR PERFORMANCE.  YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT MAY RESULT FROM YOUR ACCESS TO OUR SERVICE.  THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY WHETHER IN ACTION OF CONTRACT OR NEGLIGENCE, EVEN IF AN AUTHORIZED REPRESENTATIVE OF PB HAS BEEN ADVISED OF OR SHOULD HAVE KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES.  YOU HERE BY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE AND SERVICES AVAILABLE THROUGH THE WEBSITE. pandorabeauty.com IS THE RESELLER OF MANUFACTURER APPLIANCES AND EACH APPLIANCE COMES WITH THE MANUFACTURER’S WARRANTY.  NO APPLIANCE SOLD THROUGH OUR SERVICE IS SERVICED OR GIVEN WARRANTY BY pandorabeauty.com.  CUSTOMERS MUST CONTACT THE APPLIANCE MANUFACTURER REGARDING NON-WORKING OR BROKEN ITEMS PURCHASED VIA THE PANDORA BEAUTY WEBSITE.

 

Trademarks

 

PANDORA BEAUTY trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Website, including, without limitation, the PANDORA BEAUTY logo, are registered and/or unregistered Trademarks of PB, the website owner.  Nothing contained on the Website should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Trademark displayed on the Website without the prior written consent of pandorabeauty.com or such third party that may own the Trademarks displayed on the Website.  Your misuse of the Trademarks displayed on the Website, or any other content on the Website, except as provided in these Terms and Conditions, is strictly prohibited.

We are not responsible for the content of any sites that may be linked to or from www.pandorabeauty.com. These links are provided for your convenience only and you access them at your own risk. Any other websites accessed from the Website are independent from PB, and PB has no control over the content of those other websites. In addition, in no event shall any reference to any third party or third party product or service be construed as an approval or endorsement by PB of that third party or of any product or service provided by a third party.

 

Use of Professional Items

 

At pandorabeauty.com we have a large variety of products for “Professional Use” and “General Use”.  PB reasonably expects that all customers purchasing “Professional Use” products should know how to use them.  Regardless, pandorabeauty.com is NOT responsible for outcomes resulting from the use of products purchased from Our Website.

 

Shipping Policy

 

All purchases made through pandorabeauty.com are made pursuant to shipment contracts. All PANDORA BEAUTY packages are shipped via the United States Postal Service (USPS). We charge a Flat Rate Shipping Fee of $6.99 Anywhere in the Contintental United States including Hawaii & Puerto Rico. We currently do not ship to APO's and FPO's. We also offer FREE SHIPPING on all orders Over $99. Shipping Rates are as follows:

When will I receive my order if I choose USPS Standard Shipping Fee?

 

ALL orders require 2-3 business days for processing. Orders that contain items that are Back-Ordered or currently out of stock, processing time maybe greater. After 2-3 business days for processing, your order should arrive via the USPS, usually within 3-4 business days, or unless stated otherwise. Depending on the state you order from, the time the USPS takes to deliver your package after it leaves PANDORA BEAUTY will differ. USPS transit time for the Continental United States ranges from 2-3 business days. When estimating your package arrival time please keep in mind that PANDORA BEAUTY is a New York-based company. And again, please keep in mind we can take up to 3 business days to process an order before it ships. If you add processing time to the USPS transit time, your package can take up to 7 business days to receive so please allow up to 1 week for delivery.

 

USPS transit time to Hawaii, Alaska, Puerto Rico, and all PO, APO and FPO boxes can take up to 7 business days after the order has been shipped from pandorabeauty.com. This means your order may arrive within 10 days of placing order. Again, orders that contain items that are Back-Ordered or currently out of stock, processing time maybe greater.

 

I can not wait up to 1 week to receive my order, do you offer an Expedited Shipping Option?

 

During the checkout process you can opt for Expedited Shipping. For the low fee of $14.99 we can guarantee you will receive your order within 3 business days of placing the order. Expedited Shipping puts your order in front of the queue, hence there is no processing time. Your order will ship the very same day that you place the order. There are some requirements in order to receive the Expedited Shipping option:

 

a. Your order must be processed by 1 p.m. Eastern Standard Time.
b. All items you ordered are in stock.

 

In the case that you opt for Expedited Shipping after 1 p.m. Eastern Standard Time we can�t guarantee you will receive the order within 3 business days - in this case it may take an extra day. You will receive your order within 4 business days of placing the order.

 

In the case that you opt for Expedited Shipping and we can�t complete your order in full because something is out of stock or back ordered, you will be notified in a timely manner. We will contact you via email & phone (if phone # was given) and inform you about the situation. At this point you may request a refund for the Expedited Shipping fee in full if you are willing to wait up to 1 week to receive your order. In the case that you can�t wait you may also opt to cancel the order and request a full refund.

 

I�m worried about my order being lost or stolen, can I add Signature Required status to my order?

 

If you are placing an order to an Apartment, localized mailbox or a rural area and there is any chance your package may be stolen or lost we suggest you add Signature Required status to your order during checkout. At a low cost of $2.99 it may make sense that you have a piece of mind that your order will not end up in someone else�s hands. This means when the USPS attempts delivery to your home/apartment someone must be there to sign for the package. If no one is at home the USPS will leave a notice and you can then pickup your package at the local Post Office. Pandora Beauty doesn�t insure any packages so if the USPS delivers your package but somehow it was stolen or lost that is 100% your liability. Please note at times the USPS has been known not to leave a notice stating they attempted delivery. We advise you stay on top of your package and track it on a timely manner. Do not hesitate to contact the Post Office if you feel your package should have arrived. Keep in mind the Post Office is only responsible to only hold your package for 7 days. After this period they send the package back to us. In this case you will be required to pay Shipping again along with the additional cost of Signature Required status.

 

FYI - All orders placed with Pandora Beauty over $199 are automatically sent Signature Required at no cost to you. PANDORA BEAUTY reserves the right to add Signature Required status to any order it deems fit at no cost to you. If you wish to have your package shipped without Signature Required status you may do so by leaving us a comment in the customer notes section at the end of your checkout process. In this case please note if your package is lost or stolen it is not our liability.

 

During the 2-3 business days that it takes for Our Service to process your order, if you find you need to make a change, or add or delete an item, you may email us at support@pandorabeauty.com or call us at 1-855-332-3288. Please explain the changes you require in detail, and remember to include your Order #. If you need to make an address change, we must be notified via email/phone WITHIN the 2-3 business day processing time. We cannot make a change or edit an order after the processing time or AFTER the order has shipped. On certain occasions the 2-3 day processing time will be much shorter. In these instances if you contact PANDORA BEAUTY and your order has already been processed and/or shipped, and we cannot make any changes. Orders placed on Friday, weekends or national holidays will be processed by Wednesday, the latest, of the following week.

 

Back Orders

 

Due to our daily order volume PANDORA BEAUTY inventory levels may vary.  There are times we may be out of stock on popular items and back orders may occur.  When we are out of stock on a particular item or an item is back-ordered, we will notify the client via email.  At that time you can choose to cancel your order or wait until we have the product ready to ship.  In the case you have ordered multiple items, and one or two items are not in stock, you will be notified via email.  Here, you have several options.  You may cancel the entire order, and we will do so within 3 business days.  Your second option is for us to ship the partial order, charging you only for the items that are shipped.  You can order the other items at later date.  Your last option is to wait until the all the requested items are available, and to ship your complete order completely at that time.  We will supply you with an approximate time frame for receipt of the back-ordered items from the Manufacturer or Distributor.  You can inform us of a period of time you are willing to wait and if the items don’t arrive by then, you can opt to cancel your order completely.  Note, PANDORA BEAUTY does not ship items at separately!  You must choose one of the options above and/or cancel your order.

 

Shortages/Missing Items

 

If you receive an order from Pandora Beauty and you feel that there is a shortage or a missing item you must contact us within 24 hours of receiving the package. Keep in mind if you place an order and happen to be on vacation when the order is delivered, it is your responsibility to have it checked and call us within 24 hours if there is an issue with the order.

 

Pandora Beauty follows a strict guideline when it comes to filling orders and shipping exactly what the customer orders. We pick items by sku not by name, we weigh each item out and make sure it equals total package weight & keep track of the warehouse operator that handles your order.

 

If you call in a shortage/missing item(s) we will contact the warehouse operator immediately and have each item weighed out again and see if it matches the total weight of the package. This ensures whether or not all item(s) left our warehouse in your Pandora Beauty package.

 

We work extremely hard to make sure you receive your order complete and in a timely manner. At the same time, if we deem your calim to be false your account information will be forwarded to our Legal Department, your account will be suspended for all future purchases and all Reward Points that you had will be deleted from your account.

 

International Shipping

 

pandorabeauty.com does not currently offer International shipping options.

  • Each product line utilizes a separate Agreement.  Payment must be made, in full, 7 business days prior to the use of product line material and/or information.  Payments are only accepted for purchase by accepted major credit cards.  PANDORA BEAUTY reserves the right to cancel any Agreement between You and PANDORA BEAUTY at anytime.  After such cancelation your fee will be refunded in full.
